Si aceptamos que un ordenamiento es seguro cuando el fundamento del pronóstico goza de la probabilidad de un cumplimiento elevado, debemos concluir con pesar que la reciente pandemia del coronavirus ha generado un clima de incertidumbre que afecta a la seguridad de nuestro ordenamiento jurídico en su conjunto. En este contexto, el principio general de la buena fe debe servir para contrastar y confirmar la razonabilidad de las opciones disponibles para las partes en el Derecho legislado. Sin embargo, no debe conducir a un Derecho pretorio o judicial, sino a soluciones consagradas por la doctrina y la jurisprudencia que puedan aplicarse de forma comprensible a los hechos del caso
If we accept that a legal order is secure when the basis of the prognosis enjoys a high probability of compliance, we must regretfully conclude that the recent coronavirus pandemic has given rise to a climate of uncertainty that affects the security of our legal system as a whole. In this regard, the general principle of good faith must serve to contrast and confirm the reasonableness of the options available to the parties in the statutory law.
However, it should not lead to praetorian or judicial law, but to solutions enshrined in doctrine and case law that can be applied in a comprehensible way to the facts of the case
