      Desarrollamos en el presente estudio jurídico el concepto de reclamación y su trascendencia para la autoridad de control (como deber) y para el interesado (como derecho), la inadmisión a trámite de la reclamación y sus causas, la obligación de notificación y formas de reacción ante la resolución de inadmisión de la reclamación planteada, para finalizar con unas breves conclusiones.

      The procedure for the admission of a complaint filed with the Spanish Data Protection Agency (hereinafter AEPD) is a moment of great importance for privacy and data protection professionals. Thus, in the event that they advise a client on their complaint, they must display the necessary diligence in complying with the requirements to achieve its admission and consequent initiation of the sanctioning procedure; on the other hand, if they advise the defendant, their knowledge and skill in handling the procedure will be crucial for the interests of the defendant client. In the above circumstances, given that sanctions under the RGPD and LOPDGDD are currently being processed in full force and effect, with a significant increase in sanctioning activity and amounts imposed by the Agency, it is essential for all privacy and data protection professionals to have a good command of Articles 64.2 and 65 of the LOPDGDD. Once a complaint has been submitted to the supervisory authority, the latter, within its powers of examination, begins what it calls the «analysis phase», which includes the classification of the complaint, the formal verification of its content and the analysis of competence and other causes affecting its basis and admissibility, with the AEPD having the power to adopt the decision to reject the data subject’s complaint in whole or in part. In this legal study, we develop the concept of a complaint and its significance for the supervisory authority (as a duty) and for the data subject (as a right), the rejection of the complaint and its causes, the obligation of notification and ways of reacting to the decision to reject the complaint, and we end with some brief conclusions.
