Emocionalización de la justicia de menores.: Un análisis preliminar

    La justicia de menores interviene cuando los adolescentes cometen delitos con el objetivo de responsabilizarles por los hechos realizados, favorecer su reinserción social y evitar la consolidación de carreras delictivas. Ahora bien, las razones por las que se produce la intervención, las condiciones en que se realiza, su finalidad educativa, o el hecho de que quien juzga sea un adulto y el juzgado un menor de edad favorece que, en ocasiones, la tarea de juzgar el delito se torne en una evaluación moral del joven a través de su comportamiento externo y la exteriorización de sus sentimientos y emociones respecto al delito y la víctima del mismo. En este trabajo nos interesa centrarnos en esa dimensión emocional de la tarea de juzgar, así como en los momentos procesales que pueden ser idóneos para vislumbrar las emociones de los menores respecto al delito cometido y el daño causado: Algo que puede fomentar que se reoriente la medida judicial, o se apueste, o no, por resolver el caso extrajudicialmente. Ese análisis preliminar mediante la revisión bibliográfica nos permite pensar en la distancia existente, o no, entre moralizar al menor y responsabilizarle por el delito cometido.

    Juvenile justice intervenes when juveniles commits crimes with the main objective of holding responsible for the acts committed, promoting their social reintegration and avoiding the consolidation of criminal careers. The reasons for the intervention, the conditions in which it is carried out, its educational purpose, or the fact that the judge is an adult and the court is a minor favors that, sometimes, the task of judging turns into a moral evaluation of the juvenile through his external behavior and the externalization of his feelings and emotions regarding the crime and his/her victim. In this paper we are interested in focusing on this emotional dimension of the task of judging, specially on the procedural moments that may be suitable to glimpse the emotions of minors with regard to the crime committed and the harm caused. It is something that can reorient the judicial measure or allow resolve the case in a restorative manner. This preliminary analysis, through a bibliographical review, may allow us to think about the distance, or not, between moralizing the minor and making the person responsible for the crime committed.
