En el presente trabajo se analiza la posición de garante del empresario-empleador frente a los riesgos propios de las actividades laborales asignadas a sus trabajadores dependientes, partiendo del concepto de “riesgo permitido” en el proceso productivo peligroso y del deber de seguridad que la normativa de prevención de riesgos laborales asigna al empresario, como “organizador” del foco de peligro. Este esquema general necesita un análisis específico frente al riesgo de contagio del COVID-19 (en tanto “riesgo laboral”). Como corolario de ese estudio, se presentan aquí determinadas precisiones sobre la posible responsabilidad penal del empleador ante este nuevo riesgo vírico del que todavía se desconocen muchas características.
In this paper, the position of guarantor of the employer-employer against the risks inherent to the work activities assigned to their dependent workers is analyzed, based on the concept of "permitted risk" in the dangerous production process and the duty of safety that the regulations Occupational risk prevention assigns the employer as the "organizer" of the danger focus.
