    El favor debitorisen el Derecho Privado Romano es una regla de interpretación de las cláusulas contractuales, que en caso de duda, o si resultan vagas o ambiguas determina que éstas deban interpretarse en contra del que las dispuso (del predisponente).El principio de protección a la parte más débil, en la legislación argentina, fue traspasando el límite del Derecho Privado para adentrarse en el Derecho Público a fines del siglo XX. En el siglo XXI, la puesta en vigencia del Código Civil y Comercial de la Nación, refuerza aún más este principio.En la presente ponencia, mencionaremos las fuentes justinianeas que sostienen este principio y realizaremos una breve reseña histórica de su recepción en la legislación argentina, para luego analizar algunos supuestos que se encuentran en el libro tercero y en la parte general del Código Civil y Comercial de la Nación

    The favor debitorisin Roman Private Law is a rule of interpretation of the contractual clauses, which in case of doubt, or if they are vague or ambiguous, determines that they must be interpreted against the one who ordered them (the predisposer).The principle of protection to the weakest party, in Argentine legislation, went beyond the limit of Private Law to enter Public Law at the end of the XX century. In the XXI century, the implementation of the Civil and Commercial Code of the Nation, further reinforces this principle.In this essay, we will mention the Justinian sources that support this principle and we will make a brief historical review of its reception in Argentine legislation. Then we will analyze some examples found in the third book and in the general part of the Civil and Commercial Code of the Nation
