El Derecho público español no establece un efectivo régimen jurídico de “buenos gobernantes” y, por tanto, del “buen gobierno”. El gobernante ha de ser “sabio y justo”. La Ley debe garantizar la adecuada capacidad o solvencia del gobernante, así como su integridad y honorabilidad pública. La Ley ha de preterir eficazmente el “mal gobierno”, prohibiendo gobernar a quienes no reúnen la aptitud específica y a quienes, aun teniendo la debida capacidad, no merecen gobernar por carecer de ética pública.

Spanish public law does not establish an effective legal regime about “good rulers” or “good government”. The ruler should be “wise and just” and the law must guarantee the ruler appropriate capacity or solvency, as well as his integrity and public repute. The law must effectively prevent the “bad governments”, prohibiting the government of those without the minimum specific aptitude, capacity and public probity, even though they have the requirements demanded.
