La dimensión constitucional del régimen de responsabilidad patrimonial impone que no puedan ignorarse –por el legislador ni por el intérprete– las causas "idóneas" para ocasionar un daño. Constatada la contribución causal de la actividad administrativa y la actuación diligente del perjudicado no cabe que se exonere de plano a la Administración por no subsumirse su actuación en alguno de los supuestos previstos por el legislador. Y a la inversa, cuando el legislador ha configurado supuestos de exención de responsabilidad tampoco cabe entender que sean de interpretación restrictiva o que con ellos se agoten las circunstancias eximentes.

The constitutional dimension of the heritage liability regime requires that the “appropriate” causes of harm cannot be ignored –by the legislator or by the interpreter.
The causal contribution of administrative activity and the diligent action of the injured person determines that the Administration cannot be exempted just because its action is not subsumed in any of the cases provided by the legislator. Conversely, where the legislature has set up disclaimers, it cannot be understood that they are restrictively interpreted or that the circumstances are exhausted by them.
