Resumen de Derecho a la igualdad. Violencia doméstica y violencia de género

  El Derecho a la Igualdad es la base de la violencia doméstica y de género. La creación de esta última figura jurídica; la violencia de género, ha dado lugar a un conflicto doctrinal, pues no han faltado autores que señalan que vulnera el Derecho a la Igualdad. Sin embargo, aplicar penas distintas en función del sexo del sujeto activo y pasivo se fundamenta en la necesidad de eliminar aquellos obstáculos que impidan conseguir la igualdad entre las personas, en otras palabras, en la discriminación positiva. La sociedad española tenía el deber de crear una legislación dirigida a proteger a las mujeres de aquellas agresiones que ejercían los hombres sobre ellas, un deber cuyo origen se encuentra en los Convenios Internacionales que España había suscrito, pero ¿cumple España con los acuerdos internacionales? Por otro lado, los nuevos modelos de familia han hecho que esta figura jurídica quede en entredicho. En definitiva, la principal pregunta de investigación que planteamos es, si la violencia de género es o no inconstitucional.

  The Right to Equality is the foundation on which domestic and gender violence is based. The creation of this legal figure, Gender violence, gives rise to a doctrinal conflict since there have been authors who pointed out that it violates the Right to Equality. However, the application of different penalties depending on the sex of the active and passive subjects represents the need to eliminate those obstacles against equality between people, in other words, positive discrimination. Spanish society had the duty to create legislation aimed towards the protection of women from the attacks that men exerted on them, a duty whose origin is found in the International Agreements that Spain had signed. But, does Spain comply with international agreements? On the other hand, the new family models have put this legal figure into question. Ultimately, the main question we explore in our research is whether or not gender-based violence is unconstitutional.
