El tránsito hacia la debida diligencia obligatoria de las empresas multinacionales: la perspectiva de la Unión Europea

    La presente investigación tiene como objetivo principal indagar y llegar a conocer cómo la Unión Europea ha afrontado históricamente y hasta el momento actual el objetivo de conseguir que las empresas multinacionales consigan respetar los derechos humanos, incluidos los de carácter laboral, y el medio ambiente cuando actúan en Estados en los que tales derechos no se encuentran garantizados por la legislación interna aplicable. A tal efecto, se hará hincapié especialmente en cómo las diversas instituciones comunitarias han pasado de apostar clara y decididamente por instrumentos de carácter voluntario basados en la Responsabilidad Social Corporativa a considerar necesaria la instauración de una normativa de carácter vinculante que obligue a las empresas a aplicar sistemas de diligencia debida, extendiéndolos, en su caso, a toda su cadena de valor.

    The main objective of this research is to investigate and learn how the European Union has historically and to date dealt with the objective of ensuring that multinational companies manage to respect human rights, including labour rights, and the environment, when they operate in States where these rights are not guaranteed by the applicable domestic legislation. To this end, special emphasis will be placed on how the various EU institutions have moved from a clear and firm commitment to voluntary instruments based on Corporate Social Responsibility to considering it necessary to establish binding regulations that oblige companies to apply due diligence systems, extending them, if necessary, to their entire global supply chain.
