La nozione di ‘servus fugitivus’ in Ulp. 1 ad ed. aed. cur. D. 21.1.17 pr.-16

    In Ulp. 1 ad ed. aed. cur. D. 21.1.17 pr.-16 è conservata la più ampia articolazione superstite della giurisprudenza classica sulla nozione di ‘servus fugitivus’. L’esegesi del testo consente di individuare nel genere letterario di commento alle clausole edittali edilizie la principale fonte di riferimento per la ricostruzione della nozione in esame, seguendo lo sviluppo che la conduce dalla memoria della più antica configurazione tardorepubblicana a quella affermatasi in età imperiale ad opera della riflessione sabiniano-proculiana. Il presente contributo ambisce a superare il radicato orientamento dottrinale che individua i requisiti indefettibili per la configurazione del servo come «fuggitivo» nella necessaria compresenza della materialità della condotta e dell’elemento intenzionale: ferma restando la riflessione dei giuristi anche sugli appena menzionati elementi, infatti, l’analisi dei paragrafi ulpianei permette di individuare il vero elemento di novità dell’elaborazione giurisprudenziale sul tema, in particolare tra le età giulio-claudia e flavia, nell’approfondimento della questione relativa alla fuoriuscita del servo dalla sfera di controllo dominicale.

    In Ulp. 1 ad ed. aed. cur. D. 21.1.17 pr.-16 is preserved the widest surviving articulation of classical jurisprudence on the notion of ‘servus fugitivus’. The exegesis of the text allows to identify in the literary genre of commentary to the Curules Aediles’ Edict the main source of reference for the reconstruction of the mentioned notion, following the development that leads it from the memory of the most ancient late republican configuration to the one established in the imperial age by the Sabinian-Proculian reflection. This essay aims to overcome the deep-rooted doctrinal orientation that identifies the requirements for the configuration of the servant as «fugitive» in the necessary copresence of the materiality of conduct and the intentional component:

    it is undisputed that the reflection of jurists also takes place on the mentioned elements: nevertheless, the analysis of the paragraphs of Ulpian’s commentary allows to identify the real novelty of jurisprudential elaboration on the subject, especially between the JulioClaudian and Flavian ages, in the issue relating to the outflow of the servant from the master’s sphere of control.
