  • The Insight focuses on the impact of international human rights law and refugee law on the interpretation of the responsibility of coastal States for the coordination of rescue activities within their own SAR regions established under the SAR Convention. This analysis aims to investigate whether the interaction between these different legal frameworks produces a substantial overlapping between the extension of the search and rescue areas and the ones in which the coastal States can exercise a form of extraterritorial jurisdiction. According to the analysis conducted, the coordination of search and rescue operations, which includes the obligation to disembark survivors in a place of safety, seems to entail the exercise of an effective power over survivors and, consequently, the (automatic) recognition of extraterritorial jurisdiction of these States within their SAR regions.
