    En el presente trabajo se analizan las sentencias del Tribunal Supremo 655/2020, de 3 de diciembre, y 718/2020, de 28 de diciembre, relativas a la utilización de dispositivos técnicos de captación y grabación de comunicaciones orales en el domicilio del investigado, la interpretación de su regulación, presupuestos y los requisitos de legitimidad de la autorización judicial habilitante, con especial atención a las estancias afectadas y la duración de la medida. Asimismo, a la luz de la doctrina del Tribunal Supremo, se hace referencia a la regulación procesal, tanto a las disposiciones de común aplicación como, en particular, a la normativa específica sobre la captación y grabación de comunicaciones orales en el domicilio del investigado, con atención a la injerencia sobre los derechos fundamentales.

    This paper analyzes the Supreme Court judgments 655/2020, of December 3, and 718/2020, of December 28, regarding the use of technical devices for capturing and recording oral communications at the private residence of the person investigated, the interpretation of its regulation, budgets and the legitimacy requirements of the enabling judicial authorization, with special attention to the stays affected and the duration of the measure. Likewise, in light of the doctrine of the Supreme Court, reference is made to the procedural regulation, both to the provisions of common application and, in particular, to the specific regulations on the capture and recording of oral communications at the private residence of the person investigated, with attention to the interference on the fundamental rights.
