Propuestas de cambio regulatorio ante el conflicto taxi/VTC a partir de la óptica de competencia

    El principal objetivo de este artículo es el de formular propuestas de regulación que permitan al legislador hacer confluir los fines perseguidos por la regulación vigente en el ámbito del taxi/VTC con el máximo respeto a los principios de libertad de empresa y competencia.

    Este trabajo parte por tanto de una tarea descriptiva de la regulación actual y de las negativas y extremas consecuencias que conlleva en términos de competencia y que reiteradamente ha manifestado la Autoritat Catalana de la Competència. En definitiva, se expone la necesidad social —en términos de competencia y por tanto de bienestar del consumidor— de buscar alternativas al marco regulatorio actual.

    Con el fin de garantizar que las medidas alternativas propuestas se encuentren alineadas con los fines declarados por parte del regulador, el primer punto de esta tarea ha consistido en la exploración de los objetivos expresamente declarados por el legislador y, una vez determinados los mismos, se proponen alternativas regulatorias alineadas con dichos objetivos y que generarían una menor distorsión en términos de competencia.

    De entre las medidas propuestas, destaca una delimitación más precisa de los trayectos que efectivamente pueden considerarse de interés general y, caso de ser deficitarios, optar por su subvención directa de forma que no exista justificación posible a una limitación de la competencia ni intra ni inter modal.

    The main objective of this article is to formulate regulatory proposals that allow the legislator to bring together the aims pursued by the regulation in force in the field of taxi / VTC with the utmost respect for the principles of freedom of enterprise and competition.

    This work is therefore based on a descriptive task of the current regulation and the negative and extreme consequences that it entails in terms of competition and which the Catalan Authoritat de la Competència has repeatedly stated. In short, the social need —in terms of competition and therefore of consumer welfare— to seek alternatives to the current regulatory framework is exposed.

    In order to ensure that the proposed alternative measures are aligned with the purposes declared by the regulator, the first point of this task has been the exploration of the objectives expressly stated by the legislator and, once determined, they propose regulatory alternatives aligned with these objectives and that would generate less distortion in terms of competition.

    Among the proposed measures, a more precise delimitation of the paths that can effectively be considered of general interest stands out and, if they are deficient, opt for their direct subsidy so that there is no possible justification for a limitation of competition either intra or inter modal.
