La República Checa consagra la objeción de conciencia en sus documentos constitucionales, que regulan explícitamente la objeción de conciencia al servicio militar como un derecho humano fundamental. La característica de la objeción de conciencia general como derecho fundamental se deriva de la libertad de conciencia. A nivel legal, solo se especifica la objeción de conciencia en medicina, que se aplica en general a cualquier procedimiento médico, incluyendo abortos, eutanasia, intervenciones genéticas en embriones y similares, tanto en el caso de médicos como de profesiones no médicas. Otros tipos de objeciones se derivarán de la libertad de conciencia, sin embargo, su existencia y legitimidad están respaldadas por la jurisprudencia del Tribunal Constitucional de la República Checa, que acepta tanto la objeción de conciencia religiosa como la llamada laica. Para la República Checa, como estado predominantemente ateo, esta garantía es un apoyo muy importante para la libertad de conciencia.

The Czech Republic has the conscientious objection enshrined in its constitutional documents, which explicitly regulate the conscientious objection to military service as a fundamental human right. The characteristic of the general conscientious objection as a fundamental right follows from freedom of conscience. At the legal level, only the conscientious objection in medicine is specified, which applies in general to any medical procedure, including abortions, euthanasia, genetic interventions into embryos and the like, both in the case of doctors and non-medical professions. Other types of objections shall be derived from freedom of conscience however, their existence and legitimacy are supported by the case law of the Constitutional Court of the Czech Republic, which accepts both religious and so-called secular conscientious objection. For the Czech Republic as a predominantly atheist state, this guarantee is a very important support for freedom of conscience.
