El impuesto de plusvalía municipal fue declarado inconstitucional y nulo por parte del Tribunal Constitucional en su sentencia de 26 de octubre de 2021. Dicha declaración de inconstitucionalidad supuso la necesaria aprobación del Real Decreto-ley 26/2021, de 8 de noviembre por el que se modificaba dicho impuesto para intentar adecuarlo a los últimos pronunciamientos jurisprudenciales.
En el presente comentario nos adentramos en el análisis de la declaración de inconstitucionalidad y la modificación normativa que han dado lugar a un nuevo impuesto de plusvalía municipal con grandes diferencias respecto a su anterior regulación.
The municipal capital gains tax was declared unconstitutional and void by the Constitutional Court in its judgment of October 26, 2021.
