La constitución europea: el primer intento de la unión para consolidar su estructura constitucional

    El proceso de integración europeo siempre ha sido el modelo a seguir por todos los Estados que buscan reunirse para obtener beneficios. Esta situación ha llevado a la Unión Europea a uno de sus puntos más altos y en cierta forma decisivo para su futuro: el de la consolidación política real, plasmada en un texto constitucional. Por esto es muy importante determinar los alcances jurídicos y políticos que la Constitución para Europa pretende obtener, una vez se ratifique este texto por la totalidad de sus miembros, adopte o no el nombre de Constitución. Teniendo en cuenta lo anterior, en un primer momento la línea de investigación “La Constitución Europea: Análisis de su Naturaleza Jurídica y Política”, perteneciente al Grupo de Investigación Procesos de Integración, Regionalización y Estructuras Organizacionales – PIREO, pretendía entender la relevancia del texto constitucional propuesto y las consecuencias que el mismo depararía en un futuro, no sólo para Europa, sino para todos los Estados que siguen el ejemplo de integración europeo.1 Es por esto que en el presente trabajo se analizan los principales aspectos de la forma como se llegaron a plasmar las necesidades europeas en un sólo texto, cuáles serán sus alcances y cuál ha sido su estructura, hasta ahora.

    The European integration process has always been the model to follow for States interestedin uniting to obtain a mutual benefit. This situation has led the European Union to one ofits highest and, in some way decisive points for its future: the real political consolidationexpressed in a constitutional text. For this reason, it is very important to determine thelegal and political scope that the European Constitution will have, when the text is ratifiedby all the members and adopting or not, the name of Constitution.Keeping this in mind, the work that is being carried out by the Investigation Line “TheEuropean Constitution: Analysis of its legal and political nature”,whichbelongs to thePIREO Investigation Group, tries to understand the relevance of this constitutional text andits future consequences, not only for Europe, but for all the States that follow the Europeanintegration example.For this reason, in this work we analyze the main aspects of the way in which the Europeannecessities were summarized in a single text, its scope, and which its structure has beenuntil now
