This article investigates the regulatory and institutional systematic brought by Law No.
14.026/2020 (New Regulatory Framework for Basic Sanitation) examining the concepts and limits of the standards to be issued by the National Water and Basic Sanitation Agency, listing them to the legal and economic aspects of the regionalized provision of basic sanitation services. The contours of this sectorial restructuring will be examined in the model recently tendered in the State of Rio de Janeiro (CEDAE Auction). The investigation examines the new regulatory framework for basic sanitation from the perspective of the institution of incentives through a top-down regulation to achieve universalization and from the perspective of the new regulatory framework that aims to induce regionalized provision with a view to generation of gains of scale and the guarantee the technical and economic-financial viability of the services.
O presente estudo aborda o problema da ineficácia da aplicação de sanções administrativas Este artigo investiga a sistemática, regulatória e institucional, trazida pela Lei nº 14.026/2020 (Novo Marco Regulatório do Saneamento Básico) examinando os conceitos e limites das normas de referência, a serem expedidas pela Agência Nacional de Águas e Saneamento Básico, relacionando-os à aspectos jurídicos e econômicos da prestação regionalizada dos serviços de saneamento básico. Os contornos dessa reestruturação setorial serão examinados na modelagem recém licitada no Estado do Rio de Janeiro (Leilão da CEDAE). A investigação examina o novo marco regulatório do saneamento básico sob a perspectiva da instituição de incentivos, por intermédio de uma regulação top down, com vistas a alcançar a universalização e sob a ótica da nova arquitetura regulatória que visa induzir à prestação regionalizada, com vistas à geração de ganhos de escala e à garantia da viabilidade técnica e econômico-financeira dos serviços
