La cláusula penal, ampliamente utilizada en la práctica contractual para distintos tipos de incumplimiento, ha planteado diferentes cuestiones tanto en el ámbito doctrinal como en el jurisprudencial por su escueta regulación. La reciente publicación de una serie de Propuestas de modernización y reforma del Código Civil aporta algunas soluciones que tal vez pudieran adoptarse como respuestas novedosas a estas cuestiones, lo que hace preciso el estudio estos textos en comparación con nuestro Derecho vigente
The penalty clause, a figure frequently used by the parts of a contract for the event of non-performance, suffers from a slightly insufficient regulation in Spanish law, which has prompted both doctrine and Tribunals to try and tackle some of the questions arising around it. The recent publication of several Proposals for the modernisation and reform of the Spanish Civil Code provides some solutions that could be helpful in this regard. Therefore, the comparative study of these texts and the current regulation reveals itself as a necessity
