Planteamos en las presentes líneas un examen de la casuística que existe en los juicios de desahucio cuando el inquilino-demandado hace caso omiso de la solicitud del arrendador y le obliga a interponer la reclamación judicial. ¿Qué pasa luego si hay allanamiento? ¿Qué se entiende por la mala fe de la que habla el artículo 395 LEC? ¿Son iguales un allanamiento y la enervación? ¿Tienen los mismos efectos? Analizamos estas y otras cuestiones de interés que concurren en estos casos.
In the present article, we take up a review of the existing case law on eviction proceedings when the tenant-defendant ignores the request of the landlord and forces him to bring a suit against him. What happens then if there is a raid? What means the bad faith mentioned in Article 395 LEC (LA LEY 58/2000) (Criminal Prosecution Act)? Is the same thing a raid than an «enervación» (avoidance of forcible detainer action)? Do they have the same effects? We analyze these and other issues of interest applied in these cases.
