En este trabajo se estudia el maltrato a las personas mayores desde la perspectiva jurídico-penal. En primer lugar, se ofrece un concepto de este fenómeno para a continuación analizar las herramientas que ofrece el Derecho Penal para proteger a estas personas. Atención singularizada se otorga a los hechos cometidos en las residencias de ancianos durante la primera ola de la pandemia de COVID-19 y a su posible trascendencia penal. Finalmente, el trabajo se cierra con una serie de conclusiones y consideraciones de política criminal.

The study approaches the abuse of the elderly from a legal-criminal perspective. A legal concept of this mistreatment is offered in the first place in order to then analyze the tools offered by (Spanish) Criminal Law to protect the elder. Special focus is placed on the acts committed in nursing and retirement homes during the first wave of the Covid-19 pandemic and to their possible criminal significance. Finally, the paper closes with a series of conclusions and considerations of criminal policy regarding the issue at stake.
