Comentarios al Registro Único de Parejas Estables de la Comunidad Foral de Navarra

    La Compilación del Derecho Civil Foral de Navarra (Fuero Nuevo), en vigor desde el 19 de octubre de 2019, estableció que, en el plazo de un año desde la publicación de la ley foral, debía crearse en Navarra un Registro Único de Parejas Estables. El Decreto Foral 27/2021, de 14 de abril, es el que crea y regula este Registro Único. El presente trabajo analiza el contenido de la norma foral que regula este Registro Único de Parejas Estables de la Comunidad Foral de Navarra (acrónimo, RUPECFN). De la norma foral se valora, en primer lugar, lo necesario de su creación. Nos permite, por fin, disponer de una regulación referente y unitaria que nos proporciona seguridad jurídica. Esto, por sí solo, resulta beneficioso y positivo para los propios ciudadanos que quieren constituirse en pareja estable, para las distintas Administraciones Públicas que tengan que recabar información y para los terceros interesados “que acrediten un interés legítimo”. Se acabó la dispersión de datos y el peregrinaje de Ayuntamiento en Ayuntamiento buscando información. También, lógicamente, se hace una valoración crítica de la norma foral. Aspectos como la no concreción de la “persona encargada del Registro” que tenga esa necesaria función calificadora de las solicitudes que se realicen. La exigencia de la domiciliación de ambos miembros de la pareja en un municipio de la Comunidad Foral. Acreditar ostentar la vecindad civil foral navarra. No haber estado a la altura de la Convención de Derechos de Personas con Discapacidad en cuanto a la capacidad jurídica de las personas con discapacidad para tomar sus propias decisiones. En cualquier caso, lo positivo es que la norma foral que regula las Parejas Estables ya la tenemos entre nosotros y su desarrollo contrastará que su creación ha sido todo un acierto.

    The compilation of the foral civil law (Fuero Nuevo), in force since October 19, 2019, established that, within a year from the publication of the foral law, a Single Registry of Stable Couples should be created in Navarra. The Foral Decree 27/2021, of April 14, is the one that creates and regulates this Single Registry. The present work analyzes the content of the foral norm that regulates this Registry of Stable Couples of Navarra. The foral norm is valued, in the first place, what is necessary for its creation. Finally, it allows us to have a referencial and unitary regulation that provides us with legal certainty. This, by itsself, is beneficial and positive for the citizens themselves who want become a stable couple, for the different Public Administrations that have to collect information and for interested third parties “who demonstrate a legitimate interest”. The dispersal of data and the pilgrimage from City Hall to City Hall looking for information is over. Also, logically, a critical appraisal of the foral rule is made. Aspects such as the non-specification of the “person in charge of the Registry” who has that necessary qualifying function of the resquests that are made. The requirement of the domiciliation of both members of the couple in a Navarra address. Accredit showing the navarese foral civil neighborhood. Not having lived up to the Convention on the Rights of Persons with Disabilities in terms of the legal capacity of persons with disabilities to make their own decisions. In any case, the positive thing is that the foral norm that regulates Stable Couples is already among us and its development will contrast that its creation has been a success.
