    El auto objeto del presente comentario permite analizar la reiterada problemática sobre la naturaleza de las Federaciones deportivas españolas y, en concreto, la de las funciones desarrolladas por las mismas. La Ley 10/1990, de 15 de octubre, del Deporte, califica a la mismas como entidades privadas, no obstante, señala que, además de sus propias atribuciones, ejercen por delegación, funciones públicas de carácter administrativo, actuando en este caso como agentes colaboradores de la Administración Pública. Es el ejercicio de dichas funciones públicas el que genera el objeto de debate en el auto examinado a efectos de determinar cuál es la jurisdicción competente que ha de conocer sobre el control de tales funciones.

    The order which is about to be studied, permits the analysis of the persistent problem of the nature of the Spanish Sports Federations, concretely, that of the functions they are responsible for. The Law 10/1990 of the 15th of October related to sports, describes these federations as private entities, however, it points to the fact that apart from their own responsibilities, they also perform public administrative functions, becoming in this case assistants of the State. These public functions they carry out are what generate the debate within the order examined in the following lines. The aim of this study is to glimpse which is the competent jurisdiction that must control the public functions developed by the federations.
