Resumen de Prohibición de los TPO – a 5 años de su implementación

  A lo largo de este trabajo, se analizarán los hechos que conllevaron a la prohibición de las operaciones de TPO (acrónimo inglés de Third Party Ownership) y el objetivo que buscaba proteger FIFA con la implementación del artículo 18ter del Reglamento sobre Estatuto y la Transferencia de Jugadores, adjuntando casos enfrentados por el TAS para facilitar la comprensión de este dispositivo, diferenciándole del concepto de TPI (acrónimo inglés de Third Party Influence), que ya existía en el reglamento.

  También, se debatirá cada punto de la argumentación dada defendido por FIFA, aportando datos estadísticos y demostrando las consecuencias de esta prohibición en el mercado 5 años después, indicando las partes beneficiadas y los perjudicados durante estos años y la eficacia de la medida implementada por el órgano máximo del fútbol mundial.

  Además, se apuntarán las estrategias adoptadas por el mercado para reaccionar a esta disposición, como, por ejemplo, el cambio de entendimiento del jugador como tercero ajeno a la relación jurídica, transferencias puentes y los conglomerados de clubes.

  Por último, se defenderá la posible necesidad de la vuelta de los TPO en el actual contexto de crisis mundial, comprobándolo a través de números y previsiones oficiales mundiales delante del escenario de incertidumbre que se creó debido a la pandemia y la necesidad de que la FIFA reglamente su actuación y fiscalización, lo que será realizado mediante la propuesta de un nuevo sistema.

  Throughout this work, the events that led to the prohibition of TPO operations (Third Party Ownership) will be analyzed, which FIFA sought to protect with the implementation of article 18ter of the Regulations on the Status and Transfer of Players, attaching cases faced by the CAS to facilitate understanding of this device, differentiating it from the concept of TPI, which already existed in the regulations.

  Also, each point defended by FIFA will be debated, providing statistical data and demonstrating the consequences of this ban on the market 5 years later, indicating the benefited and harmed players during these years and the effectiveness of the measure implemented by the highest body of the football.In addition, the strategies adopted by the market to react to this provision will be noted, such as, for example, the change of understanding of the player as a third party outside the legal relationship, bridging transfers, multiclub ownership.

  Finally, the need for the return of the TPOs in the current context of global crisis will be defended, checking through official world numbers and forecasts in the face of the uncertainty scenario that was created due to the pandemic and the need for FIFA to regulate its performance and supervision, which will be done through a proposal for a new system.
