O artigo debruça-se sobre a evolução do direito do trabalho, observando o seu complexo processo de constante aperfeiçoamento e a vinculação deste aos avanços tecnológicos implementados pelas revoluções industriais. Aborda o protagonismo da Organização Internacional do Trabalho na consolidação do direito do trabalho para a proteção do trabalhador subordinado em um contexto global, com reflexos claramente perceptíveis sobre a legislação brasileira. Sustenta que assim como as revoluções industriais percursoras tiveram consideráveis impactos sobre o fato social trabalho, demandando a criação de mecanismos de proteção do trabalhador subordinado, hoje a Quarta Revolução Industrial clama por uma nova resposta jurídica para a inclusão protetiva do trabalhador digital, agora dotado de maior flexibilidade e autonomia. Sob a constatação de que o trabalho não tipicamente subordinado insere a pauta presente e futura de discussões juslaborais, o artigo defende ser chegada a hora da ampliação do objeto da disciplina, a fim de que não mais reste delimitado apenas às relações de emprego tradicionais, mas também se dedique à proteção da dignidade dos demais trabalhadores igualmente vulneráveis, porém dotados de maior autonomia, conferindo a cada qual a respectiva resposta jurídica. O artigo conclui que do mesmo modo que a criação da OIT em 1919 externou o reconhecimento da necessidade de proteção do trabalhador subordinado, modelo preponderante nos primeiros cem anos da Organização, a perspectiva futura deve também envolver a proteção dos trabalhadores dotados de maior autonomia, eis que estes, ao que tudo indica, serão a tônica do próximo centenário.

The article focuses on the evolution of labour law, observing its complex process of constant improvement and its linkage to the technological advances implemented by industrial revolutions. It addresses the role of the International Labour Organization in the consolidation of the labour law for the protection of the subordinate worker in a global context, with clearly perceptible reflexes on the Brazilian legislation. Sustain that just as the preceded industrial revolutions had considerable impacts on the social fact work, demanding the creation of mechanisms for the protection of the subordinate worker, today the Fourth Industrial Revolution calls for a new legal response to the protective inclusion of the digital worker, now endowed with greater flexibility and autonomy. Under the assumption that non-subordinate work inserts the present and future agenda of labour law discussions, the article argues that the time has come to extend the object of the discipline, in order to no more be confined to traditional employment relations, but also dedicate to the protection of the dignity of other workers who are equally vulnerable, but with greater autonomy, giving each the respective legal response. The article concludes that just as the creation of the ILO in 1919 gave rise to the recognition of the need for protection of the subordinate worker, a model preponderant in the first hundred years of the Organization, the future perspective must also involve the protection of workers with greater autonomy, because, as it seems, they will be the keynote of the next centenary.
