This study analyzed the legal nature of the conventions of the International Labour Organization, from the conception of the Supreme Federal Court in Brazil that considered that international human rights treaties, introduced in the brazilian legal order before the Constitutional Amendment n. 45/2004, they had legal nature of de supra-legal norm. The research concluded that the conventions of the International Labour Organization may also have this nature. had a legal nature of the supralegal norm. Este estudo analisou a natureza jurídica das convenções da Organização Internacional do Trabalho a partir da concepção do Supremo Tribunal Federal que considerou que os tratados internacionais de direitos humanos, introduzidos no ordenamento jurídico brasileiro antes da Emenda Constitucional n. 45/2004, possuíam natureza jurídica de norma supralegal. A pesquisa concluiu que as convenções da Organização Internacional do Trabalho também podem possuir natureza jurídica supralegal.
