Resumen de La justicia restaurativa como mecanismo de solución alternativa en el delito de extorsión empresarial

  Se expone el impacto social del delito de extorsión en México la cual es sistémica, esto implica que las organizaciones criminales cometen rutinariamente extorsiones, de manera tal, que los cobros de derecho de piso o cuotas, amenazas o engaños telefónicos constituyen una constante, las necesidades inherentes de atención y prevención en estos casos, resultando afectados el sector empresarial y de forma directa a las víctimas.  Asimismo, se realiza un análisis de las disposiciones legales de este delito en la República Mexicana y sobre la pertinencia del uso de prácticas restaurativas. En cuanto al término prácticas restaurativas, entendemos que son estrategias que se derivan del uso de la justicia restaurativa El propósito del uso de las prácticas restaurativas en el delito de extorsión es buscar la recomposición del tejido social, permitiendo la interacción entre la víctima, infractor, e inclusive con la comunidad, considerando que el infractor asuma su responsabilidad y la víctima decida como puede ser compensado.

  It is exposed the social impact of the crime of extortion in Mexico which is systematic, this implies thatcriminal organizations daily commit extortion, in such a way that the charges of right fees or threats,or telephone fraud constitute a constant, there’s the inherent needs in care and prevention in thesecases, the business sector being affected and victims directly. Likewise, an analysis is made of the legalprovisions of this crime in the Mexican Republic and on the relevance of the use of restorative practices.Regarding the term restorative practices, it is understood that they are strategies derived from the useof restorative justice. The purpose of the use of restorative practices in the crime of extortion is to seekthe recomposition of the social fabric, allowing interaction between the victim, the offender, and evenwith the community, considering that the offender assumes responsibility and the victim decides how itcan be compensated. The main objective of this work is to demonstrate analytically the feasibility andrelevance of using restorative practices in this type of crime so that these cases can be relieved quicklyand with the premise of reparation of damage in all possible areas.
