Resumen de Introduzione alla product governance. Premesse sistematiche; obblighi e responsabilità dei «produttori»

Lo studio sottolinea come con la disciplina della product governance il legislatore europea si riprometta di rispondere alle criticità emerse con la crisi del 2008. In questa chiave si evidenziano gli importanti profili sistematici esibiti dalla disciplina. L’analisi successivamente si sofferma sugli obblighi del maniofacturer anche nel suo rapporto col distributore, sottolineando come i complessi rapporti tra le due imprese debbano essere regolati da un complesso contratto. Largo spazio, poi, è riservato agli obblighi di organizzazione interna del produttore e alle conseguenti resposnabilità dei suoi organi di gestione e controllo. Infine, si prospetta l’inserimento della responsabilità del produttore all’interno della resposnabilità per attività pericolosa.

This work stresses that the european legislator promises to respond to the critical issues emerged in the 2008 crisis with the regulation of product governance. In this sense the work highlights the important systematic profiles provided by the framework. The analysis focuses later on the manufacturer duties also in its relationship with the distributor, underlining how the complex relationships between these two enterprises must be regulated by a complex contract. Then, it’s dedicated a wide space to the manufacturer duties of internal organization and to the consequent responsibilities of its management and control bodies. In the end, the study puts forward the inclusion of producer responsibility inside the tort law for “dangerous activity”.
