    El Ministerio Fiscal ocupa una posición singular en el entramado del Estado de Derecho, dada su relevante función en el seno de la Administración de Justicia y su papel de defensor de la legalidad en el proceso. Aunque no puede ser equiparado sic et simpliciter a los órganos jurisdiccionales, debe contar con un cierto grado de autonomía en el desempeño de su labor. Lo anterior contrasta con su estructura jerárquica y con la designación gubernamental de quien ostenta su jefatura máxima. De ahí que este último nombramiento venga sujeto a garantías procedimentales y materiales que son objeto de análisis en el presente trabajo.

    The Public Prosecutor’s Office occupies a unique position in the framework of the rule of law, given its important role within the Administration of Justice and its role as defender of legality in the process. However, it cannot be equated sic et simpliciter with the courts, yet it must have a certain degree of autonomy in the performance of its work. This contrasts with its hierarchical structure and the governmental designation of the person who holds its maximum leadership. Hence, this last appointment is subject to procedural and material guarantees, which are the subject of analysis in this work.
