Resumen de El impacto del Brexit en la Cooperación Jurídica Internacional en materia penal entre España y el Reino Unido

Este artículo expone las normas relativas a cooperación jurídica internacional en materia penal contenidas en la Parte III del Acuerdo de Comercio y Cooperación entre la Unión Europea y la Comunidad Europea de la Energía Atómica, por una parte, y el Reino Unido, por otra. Se centra en las áreas de cooperación jurídica internacional en materia penal más relevantes para los operadores jurídicos tanto en España (y el resto de los Estados miembros de la Unión Europea) como en el Reino Unido: cooperación con Eurojust, entrega de sujetos procesales, asistencia judicial mutua, intercambio de información sobre antecedentes penales, embargo preventivo de bienes y decomiso (Títulos VI, VII, VIII, IX y XI de la Parte III del Acuerdo). A modo de introducción, el artículo resume alguno de los hitos principales del proceso de retirada del Reino Unido de la Unión Europea (Brexi).

This paper presents the provisions pertaining to judicial cooperation in criminal matters included in Part III of the Trade and Cooperation Agreement between the United Kingdom, of the one part, and the European Union and the European Atomic Energy Community, of the other part. It focuses on the areas of judicial cooperation in criminal matters more relevant to legal practitioners both in the United Kingdom and in Spain (and other European Union member states): cooperation with Eurojust, surrender, mutual assistance, exchange of criminal record information, freezing and confiscation (Titles VI, VII, VIII, IX and XI of Part III of the Agreement). By way of an introduction, the paper provides an overview of some of the milestones in the process of withdrawal of the United Kingdom from the European Union (Brexit).
