    El medio ambienteessistema constituido por elementos naturales y artificiales que se ha visto modificado por el serhumano en el devenir histórico. En este sentido,desde distintas disciplinas se busca lograr su sostenibilidad, el Derecho ha participado a través de un estudio especializadodesde finales del siglo XXpara otorgar herramientas que coadyuven a este fin.El presente trabajotiene como objetivo exponer,de manera sucinta,el tratamiento que se da en la vigente Constitución cubana al medio ambiente, así comosus aciertos, deficienciasy retos futurosen virtud de los preceptos constitucionales que trae la nueva reforma al texto constitucional dada en el año 2019. Se realizóun análisis de los sistemas de responsabilidad por daño ambiental en Cuba encaminado a establecerpropuestas para su perfeccionamiento. También, se procedióa estudiar uno de los elementos que integran al gran universodel medio ambiente, el agua; a partirde su tratamiento en la Ley 124/2017, instrumentoque aporta respuestas a los problemas de Cuba en materia de aguas terrestres. De esta manera se concluyeque,si bienla Constitución de la República de Cuba se encamina hacia una proteccióndel medio ambiente, se hace necesaria la existencia de garantías efectivas para su materialización.

    The environment, a system made up of natural and artificial elements that has been modified by human beings in the historical becoming, in this sense, from different disciplines it seeks to achieve its sustainability, the Law has participated through a specialized study since the end of the twentieth century to grant tools that help this purpose.With regard tothis,the present work set out, in, a succinct manner, the treatment that is given in the Cuban Constitution in force to the environment, as well as its successes, deficiencies and challenges for the future under the constitutional precepts that the new reform brings to the constitutional text given in 2019.An analysis of environmental damage liability systems in Cuba was carried out to establish proposals for their improvement. He proceeded to study one of the elements that integrate the great universe of the environment, water; since its treatment in Law 124/2017, an instrument that provides answers to Cuba's problems in inlandwater. It concludes that, although the Constitution of the Republic of Cuba is directed towards environmental protection, it is necessary to have effective guarantees of protection, implying in this sense an action of the legislative body in environmental key.
