The best interests of the child enjoys universal international recognition and has acquired the status of general international law rule. It is known in different jurisdictions with the name of "Best Interests of the Child" or "the welfare of the child", in the Anglo world as "l'enfant de l'intérêt supérieur" on the French model and the world Hispanic and the principle of "best interests". In all jurisdictions, this principle is integral to the legal system for the protection of children's rights and can be considered as well, for that reason, as a "general principle of law."

El principio del interés superior del niño goza de reconocimiento internacional universal y ha adquirido el carácter de norma de Derecho Internacional General. Se lo conoce en distintos ordenamientos con el nombre de “best interests of the child” o “the welfare of the child”, en el mundo anglosajón, como “l’intérêt supérieur de l’enfant” en el modelo francés y en el mundo hispano como el principio del “interés superior del niño”. En todos los ordenamientos jurídicos, este principio forma parte integrante del sistema jurídico de protección de los derechos del niño, pudiendo ser considerado, además, por esa razón, como un “Principio General de Derecho”.
