Resumen de La intervención notarial en la transmisión mortis causa de los derechos de autor

  The ratio of copyright with the notary's act has not received the theoretical treatment it deserves and normative. The development achieved by the Copyright, their consolidation within different legal systems from improving national cultural industry will necessarily greater involvement of the notary as guarantor of legal certainty, the spontaneous realization of the law. Thus the Latin notary and the continental system of copyright must converge to the search for mechanisms of defense of Copyright in which conflicts are prevented by a route not litigious. Would then be multiple possibilities that the notary act allowed for the completion and implementation of the rules of copyright, however aim of this work is the determination of the possibilities that the act of the notary in the transmission provides mortis causa of Rights copyright, from the guarantees that it provides for the protection of the rights of both the author and his successors.

  La relación del Derecho de Autor con el actuar del notario no ha merecido el tratamiento teórico ni normativo que se merece . El desarrollo que ha alcanzado el Derecho de Autor, su consolidación dentro de diversos ordenamientos jurídicos a partir del perfeccionamiento de la industria cultural nacional provocará necesariamente una mayor participación del notario como garante de la seguridad jurídica, en la realización espontánea del Derecho. De esta forma el notariado latino y el sistema continental del Derecho de Autor deben de converger para la búsqueda de mecanismos de defensa de los Derechos de autor en los que se prevengan los conflictos por una vía no litigiosa. Serían entonces múltiples las posibilidades que el actuar del notario permitiría para la realización y aplicación de las normas de Derecho de Autor, sin embargo es objeto de este trabajo la determinación de las posibilidades que el actuar del notario brinda en la transmisión mortis causa de los Derechos de autor, a partir de las garantías que el mismo ofrece para la protección de los derechos tanto del autor como de sus causahabientes.
