In where consumer´s penal protection in Brazil is concerned, the current Code of Consumer´s Defense, different from other legislations that were examined at the time of its elaboration, with the exception of the law of the Canadian province of Quebec, it contains the definition of specific crimes against consumer relations. That because at that time (1988) it seemed essential to the commission that was in charge of the making of its rough draft that there should be rules of criminal nature, so that they would enact the enforcement of its civil and administrative protection parts. Nonetheless, and since then, it has been clear enough to the aforesaid commission that one day, in the future --- which has now arrived --- every sparse penal legislation, including the one against the consumer, should be absorbed by a new Penal Code. Therefore, the present essay intends to demonstrate and justify not only a historical trend of attempts to modify the already pre-existent laws of economic nature in the past, but also the righteousness of the proposal towards their gathering from article 427 and on in the newly drafted Penal Code, as well as, though, the gaps that have been detected.

No que concerne à tutela penal do consumidor no Brasil, o vigente Código de Defesa do Consumidor, ao contrário de outras legislações consultadas à época de sua elaboração, à exceção da lei da província canadense de Quebec, ele contém a tipificação de delitos específicos contra as relações de consumo. Isto porque àquela época (1988), pareceu essencial á comissão encarregada da redação do anteprojeto que se estabelecessem essas normas de caráter criminal, para assegurarem o cumprimento de suas partes cível e administrativa. Todavia, e desde então, ficou claro à mesma comissão que um dia, no futuro --- que agora é chegado --- toda a legislação penal esparsa, inclusive a de crimes contra o consumidor, devesse ser absorvida por um novo Código Penal. Desta forma, este ensaio visa a demonstrar e justificar não apenas um histórico das tentativas de modificação de leis já pré-existentes de caráter econômico, no passado, como também a correção da proposta de sua reunião a partir do art. 427 e seguintes do projetado novo Código Penal, bem como, todavia, as omissões que foram detectadas.
