Resumen de A reprodução assistida post mortem e o direito sucessório

  This article intends to analyze the beggining and the artificial insemination’s species and also how this subject is related with Bioethics, besides of discuss the different positions about the filiation’s presumption and the right of inheritance of the embryo produced by artificial insemination after death. As a subject that hasn’t been treated by Brazilian’s Legislation, the controversy is about the legitimacy to succeed. In case of verification about the legitimacy at the moment of the succession’s author death, the right of inheritance of the embryo produced by artificial insemination would be rejected. Meanwhile, since the civil law established the filiation’s presumption in homologous artificial insemination, even in case of the father’s decease, arose the possibility of the inclusion on succession of the son born after father’s decease, by homologous artificial insemination, under penalty of violation the filiaton’s isonomy, as a constitutionalist principle.

  O presente artigo pretende explanar sobre o surgimento e as diferentes espécies de reprodução artificial e a maneira como o tema se relaciona com a Bioética, além de discorrer sobre as distintas posições acerca da presunção de filiação e do direito sucessório do embrião fruto de reprodução assistida post mortem. Sendo tema ainda não disciplinado pela legislação brasileira, discute-se acerca da legitimidade para suceder que, se verificada no momento da morte do autor da sucessão, afastaria o direito sucessório do embrião fruto da citada técnica reprodutiva. Entretanto, com a presunção de filiação estabelecida pelo Código Civil na inseminação artificial homóloga, mesmo que falecido o pai, surgiu a possibilidade de ser incluído na sucessão o filho nascido após a morte do pai, mediante reprodução assistida homóloga, sob pena de ser violado o princípio constitucional da isonomia na filiação.
