Resumen de Pasaporte COVID, ¿libertad de circulación de forma segura o discriminación y privacidad en juego?

El 17 de marzo de 2021 la Comisión Europea presentó su propuesta de Reglamento sobre el Certificado Verde Digital, también conocido como Pasaporte COVID, acreditación digital creada con el fin de facilitar la libre circulación de forma segura durante la pandemia por COVID-19 en la Unión Europea. Meses más tarde, el 20 de mayo, el Parlamento Europeo y el Consejo llegaron a un acuerdo sobre la citada Propuesta, que pasaron a denominar «Certificado COVID Digital de la UE». Damos noticia aquí del contenido de la Propuesta, así como de las cuestiones jurídicas más controvertidas que se están planteando respecto del tratamiento de datos personales y la privacidad de los ciudadanos y que han provocado la Opinión conjunta 04/2021 del Comité Europeo de Protección de Datos (CEPD) y del Supervisor Europeo de Protección de Datos (SEPD) al respecto. Analizamos ambos documentos y vemos cómo la falsa creencia de tener que elegir entre salvar la economía, por un lado, y proteger la salud, por otro, está llevando a adoptar medidas más políticas que científicas y jurídicas, de dudosa eficacia y con un potencial efecto discriminador y lesivo de nuestra vida privada.

On March 17, 2021, the European Commission presented its proposal for a Regulation on the Digital Green Certificate, also known as COVID Passport, a digital accreditation created in order to facilitate free movement in a secure manner during the COVID-19 pandemic in the European Union. Months later, on 20th May, the European Parliament and the Council reached an agreement on the above proposal, which they called the «EU digital COVID certificate». We report here on the content of the Proposal, as well as on the most controversial legal issues that are being raised regarding the processing of personal data and the privacy of citizens and that have led to the Joint Opinion 04/2021 of the European Data Protection Board (EDPB) and the European Data Protection Supervisor (EDPS) on the matter. We analyze both documents and see how the false belief of having to choose between saving the economy, on the one hand, and protecting health, on the other, is leading to the adoption of measures that are more political than scientific and legal, of dubious effectiveness and with a potential discriminatory and harmful effect on our private life.
