Seguridad digital: ¿derecho o expectativa de derecho? A propósito del Proyecto de Carta de Derechos Digitales

    El legislador español incluyó el derecho a la seguridad digital en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de Derechos Digitales, pero no estableció por completo su contenido y quiénes son sus titulares. Este derecho ha sido también objeto de la Carta de Derechos Digitales y requiere, todavía, un desarrollo legislativo y/o jurisprudencial. En relación con este derecho, que no significa solo un derecho a la ciberseguridad, es necesario tener en cuenta referencias tan importantes como las relativas a las estrategias nacionales de Francia y Suecia en materia de seguridad digital, donde esta no se ha regulado como derecho

    The Spanish legislator included the right to digital security in the Organic Law 3/2018 of 5 december on the Protection of Personal Data and Guarantee of Digital Rights, but did not fully establish its content and who its holders are. This right has also been the object of the Charter of Digital Rights and still requires legislative and/or jurisprudential development. In relation to this right, which does not mean only a right to cybersecurity, it is necessary to take into account such important references as those relating to the national strategies of France and Sweden in the field of digital security, where this has not been regulated as a right.
