Resumen de Las relaciones fiscales de la Unión Europea y España con Gibraltar tras el Brexit

El presente estudio tiene por objeto analizar el alcance de las relaciones fiscales entre la Unión Europea (y España, en particular), de una parte, y Gibraltar, de otra, tras la entrada en vigor del Brexit una vez finalizado el período transitorio. Como es sabido la relación actual de la UE con Gibraltar se sustenta en un total de cuatro memorandos (sobre derecho de los ciudadanos, contrabando de tabaco, medio ambiente y cooperación policial y aduanera) que tenían como fecha de caducidad, salvo el primero, el 31 de diciembre de 2020. Al margen de lo anterior se ha de analizar el Tratado internacional firmado entre España y Gibraltar en marzo de 2019, que incluye un conjunto de medidas amplias destinadas a reforzar la lucha contra el fraude fiscal y el blanqueo de capitales en el Peñón, así como a fortalecer las relaciones de cooperación administrativa e intercambio automático de información entre España y Gibraltar.

The purpose of this paper is to analyze the scope of tax relations between the European Union (and Spain, in particular), on the one hand, and Gibraltar, on the other, after the entry into force of Brexit once the transitional period has ended. As is known, the current relationship of the EU with Gibraltar is based on a total of four memoranda (on citizens' rights, tobacco smuggling, environment and police and customs cooperation) that had an expiration date (except the first) the December 31, 2020. Apart from the above must be analyzed the international treaty signed between Spain and Gibraltar in March 2019, which includes a set of broad measures aimed at strengthening the fight against tax fraud and money laundering in El Peñón, as well as to strengthen relations of administrative cooperation and automatic exchange of information between Spain and Gibraltar.
