    Ante la innovación tecnológica debemos plantear si el Derecho es capaz de adaptarse a la realidad que supone la sociedad digital. En particular es imprescindible garantizar los derechos fundamentales en el nuevo entorno digital. Son varias las iniciativas que se han planteado para regular los derechos de la ciudadanía digital. En cualquier caso los derechos reconocidos en la Constitución son perfectamente trasladables al entorno digital. Podría en cualquier caso plantearse la necesidad de reconocer nuevos derechos: derecho de acceso a Internet, respeto a la identidad digital y derecho de acceso al conocimiento. La posible regulación de los derechos en la sociedad digital debe girar en torno a la persona, evitar la obsolescencia de las normas y basarse en un diálogo entre regulación y autorregulación. La regulación de las garantías de los derechos digitales en la Ley Orgánica 3/2018 habría necesitado una reflexión más intensa y sosegada

    In the face of technological innovation, we must ask whether the law is capable of adapting to the digital society. In particular, it is essential to guarantee fundamental rights in the new digital age. Several initiatives have been proposed to regulate the rights of digital citizenship. In any case, the rights recognised in the Constitution are perfectly transferable to the digital environment. The need to recognise new rights could be considered: the right to access to Internet, respect for digital identity and the right to access to knowledge. Regulation of rights in the digital society must consider the individual as the central point, avoid the obsolescence of rules and be based on a dialogue between regulation and self-regulation. The regulation of digital rights in Organic Law 3/2018 would have needed more intense and calm reflection.
