Resumen de El acceso a los datos sanitarios de los lesionados en un siniestro vial

Uno de los aspectos que ha provocado y sigue provocando dudas durante el desempeño de los cometidos de los integrantes de la Policía Judicial de Tráfico, encargados de la elaboración de los Atestados relativos a los siniestros viales, es si los centros sanitarios tienen la obligación de facilitar los datos de filiación y la naturaleza de las lesiones de las víctimas de siniestros viales o si, por el contrario, esa actuación iría en contra de la normativa que regula la protección de datos personales. A lo largo del presente artículo se realizará un recorrido por las diferentes Leyes Orgánicas que han regulado y regulan en la actualidad toda la materia de protección de datos, cubertura que otorga la Ley de Enjuiciamiento Criminal (LECrim), Interpretación de la Agencia Española de Protección de Datos y Criterios de la Fiscalía de Seguridad Vial; para, finalmente, proponer un formulario que pudiera ser utilizado para materializar la solicitud de los datos de filiación y naturaleza de las lesiones de las víctimas de un siniestro vial.

One of the aspects that has provoked and continues to provoke doubts during the performance of the tasks of the members of the Judicial Traffic Police, in charge of preparing the attestations related to road accidents, is whether health centers have the obligation to facilitate the data of affiliation and the nature of the injuries of the victims of road accidents or if, on the contrary, that action would go against the regulations that regulate the protection of personal data. Throughout this article, an analysis will be made through all the different Organic Laws that have regulated and currently regulate all the matter of data protection, coverage granted by the Criminal Procedure Law, Interpretation of the Spanish Agency for Data Protection and Criteria of the Road Safety Prosecutor’s Office; to finally propose a form that could be used to materialize the request for the information of affiliation and nature of the injuries of the victims of a road accident.
