Resumen de Prescrição off label e responsabilidade civil médica em tempos de pandemia

  OBJECTIVE: This article offers a analysis of medical responsability for off label prescriptions in times of pandemic with a focus on the COVID-19 virus.

  METHOD: Under the legal-dogmatic methodological approach, using a bibliographic review for the construction of this work, with the analysis of artiches and national doctrine on the subject, using the hypothetical-inductive method.

  RELEVANCE/ORIGINALITY: With the emergence of this and the mass use of uses outside the label of medicines, several legal disputes necessary to emerge from the doctor / pactient relationship, so that the presente study seeks to understand how a prescription occurs outside the label in Brazilian territory, analyze the paramertrs for lawful off-label uses in common times and discuss how the off-label prescription should be anlyzed in times of pandemic, identifying the requirements that would authorize such practice.

  RESULTS: As a consequence, it is understood that the medical professional who observes certain possible for off-label prescription of medications during the COVID-19 pandemic should not suffer the consequneces of civil responsability, however, casustic anlyzes should bem ade for measurement of medical guilt.

  THEORICAL / METHODOLOGICAL CONTRIBUITIONS: In common times, the rigor for off label uses must be diferente from that Applied in the times of pandemic.

  OBJETIVO: Por meio deste artigo propõe-se uma reflexão/análise acerca da responsabilidade civil médica por prescrições off label em tempos de pandemia com enfoque ao vírus COVID-19.

  MÉTODO: Sob a vertente metodológica jurídico-dogmática, utilizou-se de revisão bibliográfica para a construção deste trabalho, com a análise de artigos e de doutrina nacional sobre tema, mediante a utilização do método hipotético-indutivo.

  RELEVÂNCIA/ORIGINALIDADE: Com o surgimento dessa e a utilização em massa dos usos off label de medicamentos, diversas contendas jurídicas poderão emergir da relação médico/paciente, de forma que o presente estudo busca compreender como se dá a prescrição off label no território brasileiro, analisar os parâmetros para usos off label lícitos em tempos comuns e discorrer sobre como a prescrição off label deve ser analisada em tempos de pandemia, identificando requisitos que autorizariam tal prática.

  RESULTADOS: Por conseguinte, entende-se que o profissional médico que observar certos parâmetros razoáveis para prescrição off label de medicamentos durante a pandemia COVID-19 não deve sofrer as consequências de uma responsabilização civil, devendo, no entanto, serem feitas análises cauísticas para aferição da culpa médica.

  CONTRIBUIÇÕES TEÓRICAS/METODOLÓGICAS: Em tempos comuns, o rigor para os usos off label deve ser diverso do aplicado em tempos de pandemia.
