The text aims to present and address the issue of understanding the statute of limitations of crimes against humanity in Brazil, addressing the most relevant aspects of the subject, notably about the extradition process and the cogent nature of international norms related to these crimes.
Methodologically, we carried out a qualitative research in a case study of the Extradition Process n.
1362, in which we obtained as a result that crimes against humanity are imprescriptible, in disagreement with the decision of the Supreme Court in the aforementioned extradition process. The importance of this theme is given by the instrumental and essentially jurisdictional character of the theme.

O texto visa a apresentar e tratar a questão do entendimento da prescritibilidade de crimes contra a humanidade no Brasil, abordando os aspectos mais relevantes do tema, notadamente acerca do processo de extradição e do caráter cogente das normas internacionais relativas a esses crimes.
Metodologicamente realizamos uma pesquisa qualitativa num estudo de caso do Processo de Extradição n. 1362, em que obtivemos como resultado que os crimes contra a humanidade são imprescritíveis, em discordância com a decisão do Supremo Tribunal Federal no supracitado processo de extradição. A importância desse tema se dá pelo caráter instrumental e essencialmente jurisdicional do tema
