¿Quo vadis, incapacitación?: reflexiones iniciales sobre cierto proyecto de ley en los tiempos del coronavirus

    El presente trabajo gira en torno a las reformas que se pretenden introducir en nuestro Código civil y en otra legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica. El Proyecto de Ley que contenía dichas reformas fue presentado a las Cortes Generales en julio de 2020, y en el momento de redactarse este artículo estaba todavía en dicho momento procedimental, sin ni siquiera haberse presentado Enmiendas al mismo en ninguna de las Cámaras. Pretendemos valorar, en tan temprano momento, si la reforma diseñada es la demandada doctrinal e internacionalmente, así como atender a sus virtudes y defectos, y a su mayor o menor acierto.

    The present work is about the reforms that are intended to be introduced in the Spanish Civil Code, and another civil- and procedural legislation to support people with disabilities in the exercise of their legal capacity. The Bill that contained these reforms was presented to the Spanish Parlament in July 2020, and at the time of writing this article it was still at that procedural momentf without even perhaps presenting Amendments to it in any of the Parliamentary Chambers. We want to assess, even an early stage, if the reform designed is the doctrinally and internationally demanded one, as well as thinking about its virtues and defects, and about its greater or lesser success.
