La DGSJyFP ha construido una doctrina consolidada sobre los requisitos para que la desheredación se considere bien hecha, que son: que se haga en testamento, que se identifique en el mismo al desheredado, que tenga capacidad para ser desheredado, y finalmente, que se base en la concurrencia de una causa legal de desheredación y que esta se exprese en el testamento.
