Inteligencia artificial, una apuesta necesaria en el ordenamiento jurídico colombiano

    La tecnología y la invención del hombre en pos de su superación personal ha incidido en los grandes cambios de la humanidad, permitiendo hacer hitos históricos que reposan desde la creación del lápiz hasta el primer vuelo espacial en 1961. A esto, se anudan alianzas de las ciencias del conocimiento tradicionales junto con dichos conocimientos tecnológicos de la modernidad, haciendo cada vez más indispensable la adaptación y uso de ellas en la práctica del saber. Así, la practicada ciencia del Derecho, se ha visto inmersa en un reto de acoplamiento en el uso de TICS, propendiendo por la garantía del correcto total acceso a la justicia por parte de sus ciudadanos. Es por esto que, analizaremos en esta extensión, la forma en la que el ordenamiento jurídico colombiano ha adaptado o está en vía de adaptar el uso de las TICS para el cumplimiento de sus fines sociales y de derecho; para ello, estudiaremos en primer lugar las materias allegadas a la Inteligencia Artificial, la IA misma, los conceptos de administración de justicia, celeridad y acceso a la justicia; como también, recapitularemos los usos que ha tenido ésta en el mundo moderno y en la práctica colombiana. Permitiendo analizar a modo final, el panorama de su uso y la eficiencia que ha tenido. Todo esto, reconociendo y estudiándolo desde un punto importantísimo en la historia de la humanidad, el cual se mantiene atravesando, en consecuencia, al Covid-19 y a los dependentes retos que ha traído este a manera de adaptación tecnológica y de IA que ha tenido que efectuar el Derecho.

    The technology and the invention of the man in pursuit of his personal improvement has influenced the great changes of the humanity, allowing to make historical milestones that rest from the creation of the pencil until the first space flight in 1961. To this end, alliances between traditional knowledge sciences and modern technological knowledge are being forged, making it increasingly essential to adapt and use them in the practice of knowledge. Thus, the practiced science of law has been immersed in a challenge of coupling in the use of TICS, advocating for the guarantee of the correct total access to justice by its citizens. That is why, in this extension, we will analyze the way in which the Colombian legal system has adapted or is in the process of adapting the use of ICT for the fulfillment of its social and legal purposes; To this end, we will first study the subjects related to Artificial Intelligence, AI itself, the concepts of administration of justice, speed and access to justice; as well, we will recapitulate the uses it has had in the modern world and in Colombian practice. Allowing to analyze in a final way, the panorama of its use and the efficiency that it has had. All this, recognizing and studying it from a very important point in the history of humanity, which keeps crossing, consequently the Covid19 and to the attendant challenges that this has brought in the form of technological adaptation and AI that has had to carry out the law.
