Resumen de Síntesis de derechos en las constituciones mexicana y ecuatoriana que necesitan ser compatibles con la era digital

  La evolución de los derechos fundamentales se enfrenta a una nueva era: la digital, en la cual estos se afectan desde dos caras, en una permiten ampliar el catálogo de derechos y, en otra, resultan expuestos y vulnerables, por eso es indispensable poner en el centro de discusión la relación del Derecho Digital con las diversas disciplinas jurídicas desde una óptica en que sea compatible la protección más benéfica de las personas con esta nueva revolución industrial. Por ende, los objetivos del presente trabajo son:

  primero, exponer la actualidad constitucional de ambos países respecto a los recientes desafíos de la tecnología y; segundo, demostrar que gracias a que ya se dio el paso inicial al reconocer derechos en temas digitales, ahora, en virtud del principio de progresividad, es necesario continuar por dicho camino con el fin de que se complementen los derechos fundamentales con esta época y, así, tener una Constitución viva.

  The human rights faces a new era: the digital era, space where these rights are affected ambivalently;

  in one, it is possible to make bigger the list of rights; in another, this rights are probably easier to be violated because the cyberspace is more accessible and used by many persons and the activities are most exposed than reality face to face. This is the essential reason to put in the center of the discussion the relations of Cyber Law with the different topics of law finding the most beneficial protection of people and compatible with this new industrial revolution. Therefore, the purposes of this paper are:

  first, to expose the actuality of the Constitutions with this technology challenges and; second, to continue with the objectives to guarantee human rights in technology and, thus, have a Constitution that is alive.
