La sentencia objeto de análisis resulta de interés, fundamentalmente, debido a dos cuestiones. En primer lugar, sobre si el Reglamento de la Unión Ciclista Internacional (UCI) es fuente de la relación laboral. En este punto, resulta necesario analizar la regulación de los dos ámbitos que confluyen a efectos de dar respuesta a la citada cuestión, el deportivo y el laboral. En segundo término, es de interés examinar el tenor literal de la causa extintiva contenida en el artículo 13.g) del Real Decreto 1006/1985, de 26 de junio, es decir, por las causas válidamente consignadas en el contrato, salvo que las mismas constituyan manifiesto abuso de derecho por parte del club o entidad deportiva. Sobre esta cuestión se estudia cuál es el alcance del concepto de abuso de derecho a efectos de determinar si se ha producido en la extinción del contrato del deportista profesional del presente pronunciamiento.
The interest to analyse the current sentence lies, fundamentally, on two major questions. On the one hand, whether the Union Cycliste Internationale Rule must be considered a source for labour relation.
Regarding this matter, it is necessary to study the regulation of the fields that converge in other to answer such question, the sports law and the labour law. On the other hand, it is important to examine the literary content of the extinctive cause contained in the article 13.g) of the Royal Decree 1006/1985, 26th of June, that is, the causes that validate the extinction of a contract, excluding those that may constitute an abuse of process by the sports club or entity. In relation to this, the analysis shall focus on the limits of the abuse of process, in an attempt to elucidate whether the athlete affected in this sentence suffered from this sort of abuse or, on the contrary, he did not.
