El presente trabajo pretende abordar el conflicto existente entre el máximo organismo federativo en el ámbito del baloncesto (FIBA) y la sociedad mercantil de capital privado titular de los derechos de la “Euroleague” (ECA). Todo ello, partiendo desde los antecedentes históricos de la otrora “Copa de Europa de Baloncesto”, y pasando por sus sucesivos cambios de denominación y propiedad, a fin de terminar por plantear posibles soluciones al conflicto desde la óptica del derecho civil y mercantil español y la contraposición entre el modelo tradicional del monopolio federativo sobre las competiciones deportivas profesionales y el modelo del sport business propio de la NBA.
This paper aims to address the current conflict between the highest federation body in the field of basketball (FIBA) and the private equity company that owns the rights of the “Euroleague” (ECA). All of this, starting from the historical background of the older "European Basketball Cup" and going through its successive changes of name and ownership, in order to end up proposing possible solutions to the conflict from Spanish civil and commercial law perspective and contrast between the traditional model of the federative monopoly on professional sports competitions and the sport business model of the NBA
