A través del análisis de la tres sentencias que centraron el debate jurídico-político relativo a la idoneidad de la doctrina Parot (STS 197/2006, de 28 de marzo; STC 57/2008, de 28 de abril y STEDH Asunto Del Río Prada v. España, de 21 de octubre de 2013), así como del modelo de justicia restaurativa adoptado con posterioridad en los Encuentros de Nanclares, el presente trabajo expone algunas de las deficiencias y disfunciones del modelo penal punitivo y cómo, frente al mismo, el paradigma restaurativo supone importantes beneficios y ventajas no sólo para la víctimas del hecho criminal sino para el conjunto de la sociedad.
Through the analysis of the three judgments that focused the legal-political debate regarding the suitability of the Parot doctrine (STS 197/2006, of March 28; STC 57/2008, of April 28 and STEDH Asunto Del Río Prada v. Spain, dated October 21, 2013) and the exposition of the restorative justice model adopted in the Nanclares Meetings, this work exposes some of the deficiencies and dysfunctions of the punitive penal model and how the restorative paradigm is important benefits and advantages not only for the victims of the criminal act but for society as a whole.
