    El artículo analiza si un protocolo familiar de duración indefinida puede ser denunciado libremente por alguno de los firmantes en cualquier momento como sucede en los contratos de tiempo indeterminado. Se analizará, además de la variada tipología de protocolos, el tratamiento doctrinal dado a la cuestión y los antecedentes jurisprudenciales más recientes que se han ocupado del problema de la terminación unilateral de los pactos protocolares.

    This paper analyses whether an indefinite-term family shareholders’ agreement can be challenged without restrictions by any of the signatories as occurs with indefinite term contracts. It will also assess, in addition to the different types of protocols, how legal opinion treats the ad nutum termination of this kind of family agreements and the most recent case law that has dealt with the problem of the unilateral termination of family protocols when no specific duration has agreed.
