Se abordan aquí tres aspectos relativos a la Ley española de eutanasia, promulgada el 24 de marzo de 2021, que resultan especialmente problemáticos: la falsa configuración de la eutanasia como un ‘derecho subjetivo’, el falso protagonismo de la autonomía del sujeto y la calificación de la eutanasia como ‘muerte natural’. Se sostiene la tesis de que la ley solo ha despenalizado el delito eutanásico cuando se realiza de acuerdo con los requisitos legales; de que no existe un derecho a la muerte y por tanto no es la voluntad del solicitante la que determina la prestación eutanásica y las repercusiones que se producirán en diversos ámbitos por la calificación de muerte natural.
Three aspects related to the Spanish Euthanasia Law, promulgated on March 24, 2021, which are particularly problematic are addressed here: the false configuration of euthanasia as a ‘subjective right’, the false role of the subject’s autonomy and the qualification of euthanasia as ‘natural death’. The thesis is upheld that the Law has only decriminalized euthanasia crime when it is carried out in accordance with legal requirements; that there is no ‘right to death’ and therefore it is not the will of the applicant that determines the euthanasia benefit, and the repercussions that will occur in several areas due to its classification as a ‘natural death.
